Terms of use of the platform: plans and unified balance, AI features, rights and obligations, liability.

Terms of Service

These Terms of Service (the "Terms") are concluded between the operator of the TG Shop Constructor platform (the "Platform") and the Platform user (the "Seller", "You").

1. Definitions

  • Platform — the TG Shop Constructor SaaS service: a builder of online stores, storefronts and Telegram bots.
  • Seller — a registered user who creates stores and manages sales.
  • Buyer — a visitor of a store storefront who places orders.
  • Storefront — a public store web page with a catalog, cart and checkout, accessible by link and inside a Telegram bot.

2. Subject of the Terms

2.1. The Platform provides the Seller with tools to create and manage stores, storefronts and Telegram bots: product catalog, cart, payment processing, notifications, analytics and an AI sales agent.

2.2. The Platform is a technical tool and is not a party to, participant in, or guarantor of transactions between Sellers and Buyers.

3. Account and security

3.1. During registration the Seller provides an email address and a password and undertakes to submit accurate information.

3.2. The Seller is responsible for safeguarding their credentials and for all actions performed under their account.

3.3. The Platform may suspend account access in case of fraud, prohibited content or breach of these Terms.

4. Plans and payment

4.1. Functionality is provided under subscription plans: Start (free), Pro, Business and Enterprise. Limits and prices are published on the pricing page.

4.2. All paid services are charged from the Seller's unified balance. The balance can be topped up with bank cards, cryptocurrency, bank transfer and YooMoney.

4.3. Subscriptions renew automatically by charging the balance unless auto-renewal is disabled in the dashboard.

4.4. The AI service is billed per message: 20 free messages per day, then 2 RUB per message (a platform setting; current values are shown in the dashboard).

4.5. Services are deemed rendered from the moment a plan is activated or a specific service is charged.

4.6. A refund for the unused period of a subscription may be requested within 14 days of payment. Non-refundable: funds spent on AI messages and advertising campaigns; bonus and referral credits; amounts consumed within an active period.

5. Features and limitations

5.1. Plans limit the number of stores and products; exceeding a limit requires upgrading the plan.

5.2. Storefront branding (background, colors) is free during a 14-day trial period and is included in paid plans.

5.3. The referral program adds bonuses to the balance for invited users and their subscriptions; program terms may change with notice in the dashboard.

6. Rights and obligations of the parties

6.1. The Seller undertakes to comply with the law, to process Buyer orders and to provide accurate information about products and prices.

6.2. It is forbidden to list or sell: illegal goods, weapons and ammunition, drugs, counterfeit products, and content infringing third-party rights.

6.3. The Platform undertakes to keep the service operational, to preserve data and to announce scheduled maintenance.

7. Intellectual property

7.1. Content uploaded by the Seller (descriptions, images, trademarks) belongs to the Seller, who confirms having the rights to use it.

7.2. The Platform software and materials belong to the Operator.

7.3. By uploading content, the Seller grants the Platform a license to reproduce and display it for the purpose of providing the services (storefronts, bots, previews).

8. AI features

8.1. AI agent replies are advisory and informational; they may contain inaccuracies.

8.2. The Seller is responsible for the configuration, prompts and content of their AI agent's replies and for their compliance with the law.

9. Liability and its limitation

9.1. The Platform's aggregate liability is limited to the payments actually received from the Seller in the last 3 (three) months.

9.2. The Platform is not liable for transactions between Sellers and Buyers, for product quality and safety, or for the Seller's tax and other obligations to third parties and the state.

10. Final provisions

10.1. The Platform may amend the Terms by publishing a new version on the website and notifying Sellers in the dashboard. Continued use after the amendments take effect constitutes acceptance.

10.2. The Platform operates internationally and is not bound to the law of a single country. The relationship between the parties is governed by these Terms and by the applicable law of the User's country of residence; the mandatory rules of that law — on consumer protection, personal data, taxes and duties — prevail.

10.3. The User is independently responsible for complying with the laws of their jurisdiction, including requirements for distance selling, tax payments, export control and sanctions restrictions.
